OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. On or about December 10, 2024, at the North East side of the construction site; employees were exposed to struck-by hazards when exiting vehicles on foot and where equipment was operating.

29 CFR 1926.601(b)(14): All vehicles in use were not checked at the beginning of each shift to assure that the following parts, equipment, and accessories were in safe operating condition and free of apparent damage which could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices. On or about December 10, 2024, on the North East side of the construction site; the pneumatic system that controls the belly dump gate was not checked to verify that each component in the system maintained air pressure which affect its safe operation.
