29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a.) On or about December 12, 2024, at a church roofing site, the employer failed to instruct employees in the recognition and avoidance of fall hazards while removing insulation and installing membrane material. Employees worked on a roof with a 24-inch parapet wall on three sides and were not trained on the proper use of a complete fall protection system. As a result, employees were exposed to fall hazards of 18 feet onto a concrete surface.

29 CFR 1926.501(b)(10):"Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted. On or about December 12, 2024, located on the south side of the lower entranceway of a commercial roof, employees were performing roofing work at the unprotected edge of a flat roof without utilizing a fall protection system, exposing employees to fall hazards of 18' onto a concrete surface below.
