29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:   a) New residential construction, located at 3903 Indian Shoals Drive Bethlehem, GA 30620: On or about 12/13/2024, the employer exposed employees to struck-by hazards while performing framing operations in that head protection was not used where work was being conducted above.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  a) New residential construction located at 3903 Indian Shoals Drive Bethlehem, GA 30620:  On or about 12/13/2024, the employer exposed employees to struck-by hazards while operating pneumatic nail guns, in that protective eyewear was not provided to employees operating these tools at 110 PSI.

29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:   a) New residential located at 3903 Indian Shoals Drive Bethlehem, GA 30620: On or about 12/16/2024, the employer exposed employees to amputation and severe laceration hazards while operating a Makita 5007F Circular Saw, in that the lower guard was fixed in the open position with a shim exposing operators as the guard was unable to retract immediately after a cut was made.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     a) New residential construction located at 3903 Indian Shoals Drive Bethlehem, GA 30620, Second level and basement leading edges:  On or about 12/13/2024, the employer exposed employees to fall hazards of 12-feet to the lower concrete surface, in that a guardrails or other fall protection systems was not provided to employees engaged in framing activities.  b) New residential construction located at 3903 Indian Shoals Drive Bethlehem, GA 30620, Upper level: On or about 12/13/2024, the employer exposed employees to fall hazards of 33-feet to the lower concrete level, in that a fall protection system was not provided to employees engaged in framing activities.
