29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about December 16, 2024, the employer did not ensure that employee(s) working on a JLG 2030ES Scissor Lift at heights exceeding 6 feet were protected from falling to the concrete pad below. Employee(s) were observed stepping up on the mid-rail and sitting on the top rail of the scissor lift to perform work with no additional fall protection or personal fall arrest system in use. Employee(s) were exposed to fall related injuries such as broken bones and head, neck, spinal injuries that could result in broken bones, head/neck injuries, or permanent disability. Abated during inspection.

29 CFR 1926.452(w)(5): Scaffolds shall be stabilized to prevent tipping during movement. On or about December 16, 2024, the employer did not ensure that mobile scaffolds were stabilized to prevent tipping during movement. Employees were observed operating a JLG 2030ES Scissor Lift to lift structural components of a gazebo being installed into place. The horizontal rafter was observed to be placed across the top rails of the scissor lift with the vertical column bolted to it and hanging as the combination was lifted into place and then secured at the top in the center to previously installed rafters. Lifting and maneuvering these pieces in place exposed employees to a tip over hazard and fall or crushing related injuries which could result in broken bones, head/neck injuries or permanent disability. Abated during inspection.
