OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall, struck-by and/or caught-between hazards.  On or about December 11, 2024, employees operated a Sky Trak 5028 rough terrain forklift that was not equipped with a seat belt to protect employee from being ejected from the seat of the forklift while in operation exposing employees to falls, struck-by and/or caught-between hazards.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On or about December 16, 2024, employees were not provided with the required training and evaluation prior to operating forklifts.

29 CFR  1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  On or about December 16, 2024, the employer did not develop and maintain a written hazard communication program when employees handled hazardous chemicals such as but not limited to propane.

29 CFR  1910.1200(g)(1): Chemical manufacturers and importers shall obtain or develop a safety data sheet for each hazardous chemical they produce or import. Employers shall have a safety data sheet in the workplace for each hazardous chemical which they use.   On or about December 16, 2024, the employer did not ensure there was a safety data sheet in the workplace for hazardous chemicals such as but not limited to, propane.

29 CFR  1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.   On or about December 16, 2024, the employer did provide information and training of hazardous chemicals such as but not limited to, propane.
