29 CFR  1926.651(k)(2):Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  a) West Lark Lane Glendive, MT 59330: On or about December 16, 2024 and at times prior, employees were exposed to cave-in hazards while working in an inadequately protected trench with previously disturbed soil while installing a wastewater drain line that measured approximately 12 feet 9 inches in depth, 40 feet long, and 5 wide. The employer failed to remove employees from the trench when the distance between the bottom of the box and the bottom of the trench was greater than two feet.

29 CFR  1926.652(g)(2):Excavations of earth material to a level no greater than 2 feet (.61m) below the bottom of a shield was permitted:  a) West Lark Lane Glendive, MT 59330: On or about December 16, 2024 and at times prior, employees were exposed to cave-in hazards while working in an inadequately protected trench with previously disturbed soil while installing a wastewater drain line that measured approximately 12 feet 9 inches in depth, 40 feet long, and 5 wide. The distance measured between the bottom of the shield and the bottom of the trench was greater than two feet.
