29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation.  a) On or about December 17, 2024; and at times prior: the employer exposed employees to struck-by hazards, in that the employer did not enforce his employee(s) to wear safety glasses or face shields to protect their eyes and face while operating pneumatic nail guns to fasten decking at heights greater than 28 feet on a 12/12 pitched roof back right side of residential home.   b) On or about December 17, 2024; and at times prior: the employer exposed employees to struck-by hazards, in that the employer did not enforce his employee(s) to wear safety glasses or face shields to protect their eyes and face while operating pneumatic nail guns to fasten decking at heights greater than 28 feet on a 12/12 pitched roof middle of residential home left side.   c) On or about December 17, 2024; and at times prior: the employer exposed employees to struck-by hazards, in that the employer did not enforce his employee(s) to wear safety glasses or face shields to protect their eyes and face while operating pneumatic nail guns to fasten decking at heights greater than 28 feet on a 6/12 pitched roof back right side of residential home.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)    a) On or about December 17, 2024 and times prior, the employer exposed employees to fall hazards, in that the employer allowed employees to install deck board on the roof of a 6/12 pitched roof with no fall protection on while being at heights greater than 28 feet.  b) On or about  December 17, 2024 and at times prior, the employer exposed employees to fall hazards, in that the employer allowed employees to install deck board on the roof of a 12/12 pitched roof with no fall protection on while being at heights greater than 28 feet.   c) On or about  December 17, 2024 and at times prior, the employer exposed employees to fall hazards, in that the employer allowed employees to install deck board on the roof of a 12/12 pitched roof with no fall protection on while being at heights greater than 28 feet.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed  a) Garage area of structure: On or about December 17,2024; and at times prior: employer exposed employee(s) to fall hazards, in that the employer did not have three feet of siderails extending past the upper landing of the second story for the employees to safely access the second story of the jobsite.

29 CFR  1926.1053(b)(8):Ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were not secured to prevent accidental displacement, nor was a barricade used to keep the activities or traffic away from the ladder.  a) Garage area of structure: On or About December 17, 2024; and at times prior: employer exposed employee(s) to fall hazards, in that the employer did not tie down the top of the ladder to the structure for employees to gain access to the working location on the second story of the new residential home located at lot 12 inside of the garage approximately 12 feet off the ground.

29 CFR  1926.1053(b)(9):The area around the top and/or bottom of (a) ladder(s) was not kept clear.  a) Garage area of structure: On or about December 17, 2024; and at times prior, the employer exposed employees to trip hazards, in that the employer did not maintain the area around the bottom of the ladder free of debris and other material in that the employer allowed building materials to be stored at he base of the ladder that employees utilize to gain access to the work site.
