29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met, and had not developed or implemented a written hazard communication program which included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): a) Morgan Automotive, Inc., 850 Lancaster Road, Manheim, PA 17545 - On or about December 19, 2024, employees are engaging in cleaning activities and using products containing hazardous chemicals, and the employer is not developing, implementing, or maintaining a written hazard communication program at the workplace. This violation was ongoing as of April 2, 2025. To abate this ongoing violation, the employer must develop, implement and maintain a written hazard communication program. Morgan Automotive, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1200(e)(1), which was contained in OSHA inspection number 1736587, citation number 1, item number 1-a and was affirmed as a final order on September 9, 2024, with respect to a workplace located at 850 Lancaster Road, Manheim, PA 17545. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

This violation was ongoing as of April 2, 2025.
