29 CFR 1910.178(a)(4): Capacity, operation, and the maintenance instruction plates, tags, or decals were not changed accordingly when modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer: a) On or about December 19, 2024, in building 225, the employer did not ensure the capacity listed on the data plate on the Nissan by Unicarriers forklift number 135 (serial number: CT1B2-981755) was changed when the forklift attachment was modified from forks to a single double pallet handler, exposing employees to hazards associated with overloading or tip-overs. b) On or about December 12, 2024, in building 225, the employer did not ensure the capacity listed on the data plate on the Nissan by Unicarriers forklift number 137 (serial number: CTG1B2-970777) was changed when the forklift attachment was modified from forks to a single double pallet handler, exposing employees to hazards associated with overloading or tip-overs.

29 CFR 1910.178(a)(6): The employer did not ensure that all nameplates or markings were maintained in a legible condition: a) On or about December 19, 2024, the employer did not ensure the Nissan by Unicarriers forklift number 128 (serial number: CT1B2-981185) was equipped with a data plate in which the rated load capacity was legible while employees used it to move scrap metal in building 282, exposing employees to hazards associated with overloading or tip-overs. b) On or about December 19, 2024, the employer did not ensure the Nissan by Unicarriers forklift number 129 (serial number: CT1B2-981190) was equipped with a data plate in which the rated load capacity was legible while employees used it to move pallets of cans and lids in building 225, exposing employees to hazards associated with overloading or tip-overs. c) On or about December 19, 2024, the employer did not ensure the Nissan by Unicarriers forklift number 130 (serial number: CT1B2-981193) was equipped with a data plate in which the rated load capacity was legible while employees used it to move pallets of cans and lids building 225, exposing employees to hazards associated with overloading or tip-overs.

29 CFR 1910.178(o)(2): Load(s) were being handled which exceeded the rated capacity of the industrial truck(s): On or about December 19, 2024, in building 282, the employer did not ensure that the Nissan by Unicarriers forklift number 128 (serial number: CT1B2-981185) was prevented from being used to handle loads exceeding the rated capacity in that it was used it to move pallets of scrap metal weighing between 3935lbs-5075lbs which exceeds the lift's capacity of 2,175 lbs. with the single double pallet handling attachment, exposing employees to hazards associated with overloading and tip-overs.
