OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards: On or about December 23, 2024, Cuyahoga Landmark, Inc located at 21079 Westwood Dr., Strongsville, OH 44149, the employer failed to anchor and bolt down the north warehouse storage racks to prevent employees from exposure to struck-by and/or crush-by hazards when moving 55-gallon drums of motor oil, antifreeze and mineral spirits and pallets of various oil products to using a powered industrial vehicle.

29 CFR 1910.36(b)(1): An exit door must be unlocked. Employees must be able to open an exit door from the inside at all times without keys, tools or special knowledge. A device such as a panic bar that locks only from the outside is permitted. On or about December 23, 2024, Cuyahoga Landmark, Inc., in the Oil Products Warehouse failed to ensure that at least two exit routes, were available in the immediate area to provide alternate means for employees to leave the workplace safely during an emergency.
