29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  At a worksite located at or near 13667 N Kentwood Lane, Neosho, MO 64850:   Operators were exposed to struck-by and crushed-by hazards from earthmoving equipment. This was demonstrated on or about December 20, 2025. Two authorized operators were performing work on foot next to a running piece of earthmoving equipment (Bobcat E35i mini excavator). Operators were not instructed on how to recognize and avoid potentially unsafe conditions arising from the unexpected movement of the equipment; including but not limited to, understanding the operational controls and warning labels.

29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  At a worksite located at or near 13667 N Kentwood Lane, Neosho, MO 64850:   Employees were exposed to daily hazards that include and are not limited to struck-by and crushed-by hazards from earthmoving equipment. This was demonstrated on or about December 20, 2025. Two authorized operators were performing work on foot next to a running piece of earthmoving equipment (Bobcat E35i mini excavator). The employer failed to initiate and maintain an accident prevention program that provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons; as well as the use of any machinery, tool, material, or equipment which is not in compliance with any applicable requirement of this part is prohibited.

29 CFR 1926.50(b): Provisions were not made prior to commencement of the project for prompt medical attention in case of serious injury:  At a worksite located at or near 13667 N Kentwood Lane, Neosho, MO 64850:   Workers were exposed to struck-by and crushed-by hazards from earthmoving equipment causing a serious injury. This was demonstrated on or about December 20, 2024, the employer failed to ensure that employees knew how to effectively contact medical services in the event of an emergency.  A five-person crew performed utility installation services with heavy equipment that included a Ditch Witch directional drill and Bobcat E35i mini excavator.  Two employees were crushed-by the excavator.  The uninjured employees did know how to summon emergency services and relied on nearby homeowners to call for assistance.

29 CFR 1926.600(a)(3)(i): Scraper blades, end-loader buckets, dump bodies, or similar equipment of heavy machinery were not fully lowered, controls were not put in the neutral position, and motors were not stopped when the machinery was not in use.  At a worksite located at or near 13667 N Kentwood Lane, Neosho, MO 64850:   Workers were exposed to struck-by and crushed-by hazards from earthmoving equipment. This was demonstrated on or about December 20, 2025. wo authorized operators were performing work on foot next to a running piece of earthmoving equipment (Bobcat E35i mini excavator). One of the operators was attempting to thaw a frozen hose in the cab of the earthmoving equipment when an operator unengaged the equipment's console lock lever. Once unengaged the console lock lever allowed for the equipment components to become operational. The employer failed to ensure that when machinery was not in use that controls were put into the neutral position, and the motor was stopped.
