29 CFR 1910.136(a): The employer did not ensure that each affected employee used protective footwear when working in areas where there was a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, and where such employee's feet were exposed to electrical hazards: a) On December 9, 2024, at 4525 Collins Avenue, Miami Beach, Florida, an employee was exposed to struck-by and amputation hazards when working without foot protection while lifting a road case containing a subwoofer, which the bottom part unexpectedly detached and landed on his foot.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): (a) On or about December 10, 2024, on a site located at 2724 West 79th Street, Hialeah, Florida, the employer failed to perform a PPE hazard assessment when moving natural stone slabs with a forklift while handling slabs with a clamp. a) On December 9, 2024, at 4525 Collins Avenue, Miami Beach, Florida, the employer did not perform a PPE hazard assessment for an employee engaged in the task of lifting a road case containing a 137-pound piece of equipment; the employee was exposed to struck-by and amputation hazards when performing the task without protective foot wear.
