29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: a) Corner of North Perry St. and Randolph St., Montgomery AL; On or about December 28, 2024, and at times prior to, the employer exposed his employees to fall hazards of approximately 37 feet in that employees were allowed to work in the basket of a Genie S-85 S/N S8514-11869 Aerial Lift without the use of fall protection.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of aerial lift being used and to understand the procedures to control or minimize those hazards: a) Corner of North Perry St. and Randolph St., Montgomery AL; On or about December 28, 2024, and at times prior to, the employer failed to ensure that employees were trained to recognize the hazards associated with the use of aerial lifts, such as but not limited to the use of fall protection, when operating a Genie S-85 S/N S8514-11869 Aerial Lift.
