29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  Site: 114 Malba Drive, Whitestone, NY 11357. a). On or about January 2, 2025, AZR Homes Construction employees were engaged in welding on the second story of a new building without using eye or face protection and exposed to flying metal spark particles.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Site: 114 Malba Drive, Whitestone, NY 11357. a) On or about January 2, 2025, AZR Homes Construction Inc. employees installing a deck/second story platform approximately 12 ft above the ground level were not protected from falling.  Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  Site: 114 Malba Drive, Whitestone, NY 11357. a). On or about January 2, 2025, AZR Homes Construction employees engaged in welding a metal deck from a two-frame supported scaffold were working from a platform that was missing a plank and had a gap of approximately 18 inches. The working level was approximately 6ft from the ground level exposing employees to a fall hazard.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1926.451(e)(1): A means of access for scaffold platforms more than 2 feet (0.6 m) above or below a point of access, such as portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used.    Site: 114 Malba Drive, Whitestone, NY 11357. a).  On or about January 2, 2025, AZR Homes Construction employees engaged in the installation of a new building deck /second-story platform were climbing on a supported scaffold to access the working platform that was approximately 12 ft above the lower level and were exposed to falls.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
