29 CFR 1926.1053(b)(6):Ladders shall be used only on stable and level surfaces unless secured to prevent accidental displacement. a) On or about January 2, 2025, at the worksite located at 3505 Lake Butte Des Morts Drive, Oshkosh, Wisconsin; the employer did not ensure that an employee performing framing work on the fourth floor working from a step ladder near the building edge was protected from falls, exposing an employee to fall hazards. The employee was working from a step ladder that had it's feet resting on a 4x6 framing timber at the edge of a four story balcony.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On or about January 2, 2025, at the worksite located at 3505 Lake Butte Des Morts Drive, Oshkosh, Wisconsin; the employer did not ensure that an employee performing framing work on the fourth floor working from a step ladder near the building edge was protected from falls, exposing an employee to fall hazards. The height of the fourth floor was greater than 25 feet above a lower level. Olivares Framing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1785928, citation number 1, item number 1, and was affirmed as a final order on December 13, 2024, with respect to a workplace located at 3505 Lake Butte Des Morts Drive, Oshkosh, WI 54904.
