1926.503(c)(3):  When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicated that the employee had not retained the requisite understanding or skill, the employer did not retrain each employee:  29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  Location: 123 Milk St, Westborough, MA-roof  Employer's employee had insufficient knowledge of fall protection systems.  As a result, on January 3, 2025, workers were  exposed to fall hazards of up to 10 feet to  to the ground while conducting roofing activities where fall protection was not used.

1926.1060(a)(1)(iii):  The employer did not ensure that each employee using ladders and/or stairways had been trained by a competent person in the proper construction, use, placement, and care in handling the ladders and/or stairways:  Location: 123 Milk St, Westborough, MA  On January 3, 2025, subcontractor employees were exposed to falls from heights up to 10 feet to the ground while accessing an upper landing surface where an extension ladder was used to access a residential roof, the ladder was set up on the gable end of the roof, and the side rails of the ladder were not supported equally.  The employer did not ensure that their employees were adequately trained.
