29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)Muth Electric, Inc. at 688 Dakota Avenue South, Huron, SD 57350: On or about and at times prior to January 2, 2025, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Employees were conducting various construction operations on a commercial property without the use of a subcontracted certified crane operator, employees were using an unserviceable lifting strap which did not receive a shift inspection to verify it was safe to use for lifting activities, and the subcontracted crane in use lacked daily, monthly, and annual inspections while the mobile hydraulic crane performed lifts.  This condition exposed employees to struck-by hazards.
