29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   (a) 321 Lafayette Avenue Kenilworth, NJ 07033  On or about 01/03/25 and thereafter, employee(s) were provided and required to use half-face air-purifying respirators, for which the employer did not have a written program for administering the use of respiratory protection in the workplace. The employer required employees to wear respirators for welding fumes protection, while welding stainless steel and aluminum.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) 321 Lafayette Avenue Kenilworth, NJ 07033 Welding shop  On or about 01/03/25 and thereafter,  employee(s) were provided and required to use half-face air-purifying respirators, such as 3M 7503 Half-face respirators with HEPA filters and 3M 2097 P100, for which the employer did not provide a medical evaluation to employees to determine their ability to use a respirator before requiring use.  The employer required employees to wear respirators for welding fumes while performing    Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.

29 CFR  1910.134(k)(3): Training was not provided prior to requiring employees to use a respirator in the workplace:   (a)321 Lafayette Avenue Kenilworth, NJ 07033 Welding shop  On or about 01/03/25 and thereafter, employee(s) were provided and required to use half-face air-purifying respirators, such as 3M 7503 Half-face respirators, for which training is not provided on respirator inspection, use (including seal-check), maintenance & storage.  The employer required employees to wear respirators for protection from welding fumes while performing welding operations  without providing training prior to start of assignment.
