29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) 2120 Fairmont Ave, Reading, PA; Basement boiler room - On or about December 31, 2024, employees had entered a trench measuring approximately 45 feet long, 55 inches wide and between 3.9 feet and 8.5 feet deep without cave-in protection in place, which exposed the employee(s) to an engulfment hazard. (b) 2120 Fairmont Ave, Reading, PA; Pit on the exterior of the basement boiler room - On or about January 2, 2025, employees had entered an excavation measuring approximately 5 feet wide by 5 feet long and 9 feet deep without cave-in protection in place, which exposed the employee(s) to an engulfment hazard. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.652(a)(2): Protective systems did not have the capacity to resist without failure all loads that were intended or could reasonably be expected to be applied or transmitted to the system: (a) 2120 Fairmont Ave, Reading, PA; Basement boiler room - On or about January 2, 2025, the employer had installed trench shoring which did not have the capacity to resist a side load from the trench wall without failure due to being constructed from wood planks which were nailed together. Employee(s) were exposed to an engulfment hazard in the event of a trench collapse. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.651(g)(1)(i): Where oxygen deficiency (atmosphere containing less than 19.5 percent oxygen) or a hazardous atmosphere existed or could reasonably be expected to exist, such as in excavations in landfill areas or excavations the in areas where hazardous substances are stored nearby, the atmospheres in the excavation shall be tested before employees enter excavations greater than 4 feet (1.22 m) in depth: (a) 2120 Fairmont Ave, Reading, PA; Basement boiler room - On or about December 31, 2024, employees had entered a trench measuring approximately 45 feet long, 55 inches wide and between 3.9 feet and 8.5 feet deep without first performing a test of the atmosphere in the trench. Employees were exposed to respiratory hazard(s) caused by potential exposure to hydrogen sulfide and methane. (b) 2120 Fairmont Ave, Reading, PA; Pit on the exterior of the basement boiler room - On or about January 2, 2025, employees had entered an excavation measuring approximately 5 feet wide by 5 feet long and 9 feet deep without first performing a test of the atmosphere in the excavation.
