29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i). On or about January 7, 2025 and at prior times, in the west side loading dock area, employees operating forklifts and performing other work activities were not protected from a fall greater than 4 feet to a lower level.

29 CFR 1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tank cars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6. On or about January 7, 2025, in the receiving staging area of the warehouse, employees worked around bundles of palletized freon tanks that were stored laying down on their sides.
