29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) 2nd level, Lot #137: On 1/9/2025, the employer exposed employees to fall hazards of up to approximately 20-feet to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities.  b) 2nd level, Lot #138: On 1/9/2025, the employer exposed employees to fall hazards of up to approximately 22-feet to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities.

29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  a) Lot #137 and #138, Ground floor: On  1/9/2025, the employer exposed employees to struck-by hazards, in that the employer did not ensure that the forklift operator on site  had been trained and certified to operate the forklift truck used to elevate building materials to the upper levels  and the roof.
