29 CFR 1910.67(c)(2)(v): A personal fall arrest or travel restraint system that meets the requirements in subpart I of this part was not worn and attached to the boom or basket when working from an aerial lift: a) Ace's Affordable Tree Removal Services, Inc., at jobsite located at 3130 Central Park West, Toledo, Ohio: On or about January 8, 2025, the employer failed to ensure that employee(s) operating aerial lift donned and secured their personal fall arrest systems before operating a I 80 Equipment DT 466E Boom Truck. Employees performing tree trimming work activities inside the bucket at heights without the benefit of personal fall arrest systems were exposed to falls of approximately 15 feet or greater to the ground below.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects: a) Aces' Affordable Tree Removal Services, Inc. at worksite located at: On or about January 8, 2025, the employer failed to ensure that employees were protected from head injury hazards by protective hardhats while working on the ground below as employees above actively engaged in tree trimming activities from an aerial lift. Employees operating in this condition were exposed to head injuries from falling object hazards such as tools and tree debris.
