29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) On or about January 8th, 2025 the employer South Creek Construction LLC working at the jobsite located at 2600 Carronade Drive, Perrysburg, OH 43551 did not have a plan or a program to identify job site hazards which assists employees in accident prevention and maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls and struck by hazards during job site operations, decreasing the probability of employee injury or illness. To effectively abate this violation, the employer must provide evidence demonstrating that appropriate safety and health programs have been implemented avoid fall hazards on its worksites.

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) On or about January 8th, 2025 the employer South Creek Construction LLC working at the jobsite located at 2600 Carronade Drive, Perrysburg, OH 43551 did not have a fall protection training program in place to enable each employee to recognize the hazards of falling, and procedures to minimize these hazards. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury or illness.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) On or about January 16th, 2025 the employer South Creek Construction LLC working at the jobsite located at 2600 Carronade Drive, Perrysburg, OH 43551 did not ensure that each affected employee used appropriate eye or face protection when performing roofing and framing work on a new-build residential multi-family apartment unit complex while exposed to potential struck by hazards (flying particles/debris) while using pneumatic nail guns.

29 CFR  1926.453(b)(2)(v):A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  a) On or about January 16th, 2025 the employer South Creek Construction LLC working at the jobsite located at 2600 Carronade Drive, Perrysburg, OH 43551 did not ensure that employee(s) operating a Genie Brand S-60x articulating mobile scaffold (aerial lift) donned and secured their personal fall arrest systems before operating the aerial lift. Two employees operating this were exposed to falls of 6 feet or greater to the ground below in that a fall protection harness and lanyard was not utilized by the employee when using the mobile scaffold to perform framing activities on a residential construction site.

29 CFR  1926.502(d)(16)(iii):be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level;  a) On or about January 8th, 2025 the employer South Creek Construction LLC working at the jobsite located at 2600 Carronade Drive, Perrysburg, OH 43551 failed to ensure personal fall arrest systems utilized by employees working from a roof deck performing framing work activity were rigged and/or adjusted in a way that, in the event of a fall, would prevent workers from contacting the ground below. In that anchoring points and rope grabs were not adjusted to protect employees from an approximate 12ft free fall while performing roofing work on the roof line.
