29 CFR  1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) 34 Court Street, Binghamton, NY on the scaffold.  On or about 1/10/25:  Workers demonstrated a lack of proficiency in working from scaffolding, specifically when observed climbing cross braces, working without  fall protection, and when connecting personal fall arrest equipment in a manner that is outside the design of that equipment and in selection of anchorages that would not provide the required tensile strength.  a Serious citation was issued for this item that citation required abatement documentation which the employer did not provide.     Abatement documentation must be submitted for this item.

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a) 34 Court Street, Binghamton, NY on the scaffold.  On or about 1/10/25:  Workers performed tasks from a scaffold pick 13 feet to ground and 6 feet 4 inches to the next lower level.  The configuration of the lower level was that fall would result in a 13 foot fall.  Workers were not protected from falling by either a personal fall arrest system or guardrail system.  b) 34 Court Street, Binghamton, NY on the scaffold.  On or about 1/10/25:  Workers performed tasks from a scaffold pick 19 feet 4 inches to ground and 12 feet 8 inches to the next lower level.  Workers were not protected from falling by either a personal fall arrest system or guardrail system.  c) 34 Court Street, Binghamton, NY on the scaffold.  On or about 1/10/25:  Workers performed tasks from a scaffold pick 25 feet 8 inches to ground and 19 feet 2 inches to the next lower level.  Workers were not protected from falling by either a personal fall arrest system or guardrail system.  d) 34 Court Street, Binghamton, NY on the scaffold.  On or about 1/10/25:  Workers performed tasks from a scaffold pick 32 feet 4 inches to ground and 25 feet 6 inches to the next lower level.  Workers were not protected from falling by either a personal fall arrest system or guardrail system.  e) 34 Court Street, Binghamton, NY on the scaffold.  On or about 1/10/25:  Workers performed tasks from a scaffold pick 38 feet 8 inches to ground and 31 feet 6 inches to the next lower level.
