29 CFR 1910.1052(c)(1): The employer did not ensure that no employee(s) was exposed to an airborne concentration of methylene chloride in excess of twenty-five parts per million as an 8-hour time weighted average (TWA): (a) In the production area, on or about May 16, 2025, the employer did not ensure that no employees were exposed to an airborne concentration of methylene chloride in excess of the permissible exposure limit of 25 parts per million (8-hour TWA) for an employee that was exposed to an 8-hour time-weighted average of 131 parts per million, thereby exposing the employee to a chemical hazard. (b) In the production area, on or about May 16, 2025, the employer did not ensure that no employees were exposed to an airborne concentration of methylene chloride in excess of the permissible exposure limit of 25 parts per million (8-hour TWA) for an employee that was exposed to an 8-hour time-weighted average of 90 parts per million, thereby exposing the employee to a chemical hazard. (c) In the production area, on or about May 16, 2025, the employer did not ensure that no employees were exposed to an airborne concentration of methylene chloride in excess of the permissible exposure limit of 25 parts per million (8-hour TWA) for an employee that was exposed to an 8-hour time-weighted average of 41 parts per million, thereby exposing the employee to a chemical hazard.

29 CFR 1910.1052(j)(1)(i): The employer did not make medical surveillance available for employees who were or potentially were exposed to methylene chloride at or above the action level on 30 or more days per year, or above the 8-hour time weighted average permissible exposure limit or the short term exposure limit on 10 or more days per year: (a) In the production area, on or about January 14, 2025, the employer did not make medical surveillance (including medical and work history, physical examination, laboratory surveillance, and any other necessary information a physician or other licensed health care professional determines necessary to assess employee health in relation to methylene chloride) available for employees who were exposed to methylene chloride at or above the action level on 30 or more days per year, thereby exposing the employee to a chemical hazard.
