29 CFR  1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:  On or about 01/16/2025 at 127 12th Street, Brooklyn, NY 11215, employees working on the lacquer machine lines were exposed to the inhalation of hazardous chemicals including but not limited to Xylene 10-20% contained in the Durchen Gloss Clear Bake product used to coat container caps. The employer did not evaluate the respiratory hazards and determine a reasonable estimate of line worker exposure to the hazardous chemicals.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19
