29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about January 16, 2025, employees shingling a single level residential roof while using pneumatic nail machines were doing so without the use of eye protection exposing the employees to eye or face hazards from flying particles.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b)  On or about January 16, 2025, employee installing shingles on the roof of a new construction single level residential building, at a height greater than six feet, were not protected from falls to the lower level.
