29 CFR  1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  On or about January 22, 2025, the employer did not provide a medical evaluation program for employees who are required to use respirators in the workplace including the 3M Half Face Respirator 07025. The employer requires employees to wear the respirators for operations where they are exposed to respirable hazards including but not limited to fiberglass dust and other respirable materials when sanding or grinding down parts of the vehicle frames or doors.

29 CFR  1910.134(f)(2): The employer did not ensure that employees using a tight-fitting facepiece respirator was fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) was used, and at least annually thereafter.  On or about January 22, 2025, the employer did not develop and implement an effective fit testing program that evaluates employees' effectiveness in wearing a respirator including the 3M Half Face Respirator 07025. The employer requires employees working inside of booths to wear the respirators for operations where they are exposed to respirable hazards including but not limited to fiberglass dust and other respirable materials that are generated when conducting operations such as sanding or grinding down parts of the vehicle frames or doors.

29 CFR  1910.134(k): The employer did not provide effective training to employees who are required to use respirators. The training must be comprehensive, understandable, and recur annually, and more often if necessary. This paragraph also requires the employer to provide the basic information on respirators in Appendix D of this section to employees who wear respirators when not required by this section or by the employer to do so.  On or about January 22, 2025, the employer did not conduct employee respirator training for employees who require the use of respirators in the workplace. This includes job operations such as but not limited to grinding and sanding operations inside booths 3008 and 3800 where employees work on the vehicles' doors and the frame of the vehicle. Employees in these booths use respirators including but not limited to Powered Air Purifying Respirators or the 3M Half Face Respirator 07025 to protect against respirable hazards including but not limited to fiberglass dust.
