29 CFR  1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces:  (a) 1834 S Queen Way, Lakewood, CO 80232: On or about December 9, 2024, the employer did not evaluate if the attics were permit-required confined spaces.  Employees entered the kitchen attic to remove insulation using a Krendl GV230 Belt Driven Gas Vacuum system and were overcome by carbon monoxide.  This condition exposed employees to serious respiratory hazards and falls to lower levels.

This condition exposed an employee to carbon monoxide resulting in hospitalization.

29 CFR  1910.146(c)(4): The employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:  (a) 1834 S Queen Way, Lakewood, CO 80232: On or about December 9, 2024, the employer did not implement a written permit space entry program that complied with 29 CFR 1910.146.   Employees entered a permit required confined space without performing an evaluation of all potential hazards, employees did not have the knowledge and means to identify permit required confined spaces, evaluate the hazards of spaces and make safe entry. This condition exposed employees to a hazardous atmosphere containing carbon monoxide while removing insulation in an attic using a Krendl GV230 Belt Driven Gas Vacuum and resulted in an employee hospitalization.

29 CFR  1910.146(g)(1):The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146 (permit required confined spaces) acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146:  (a) 1834 S Queen Way, Lakewood, CO 80232: On or about December 9, 2024, employees removing insulation from the kitchen attic were not knowledgeable and able to demonstrate an understanding of confined space hazards and requirements of permit entry.  An employee working in the attic was exposed to carbon monoxide, resulting in hospitalization.

29 CFR  1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of carbon monoxide listed in Table Z-1 in excess of the 8 hour Time Weighted Average concentration of 50 parts per million(ppm) of air:  (a) 1834 S Queen Way, Lakewood, CO 80232: On or about December 9, 2024, an employee engaged in blown-in insulation removal and was exposed to carbon monoxide buildup, which may have been produced by a gasoline-fueled Krendl GV230 Belt Driven Gas Vacuum system.  An employee became ill with symptoms of severe weakness, lightheadedness, shortness of breath, and syncope which are characteristics of carbon monoxide poisoning. That employee was subsequently taken to a local hospital and diagnosed with carbon monoxide poisoning.  The exposure concentration was calculated based on the post-exposure sampling for percentage carboxyhemoglobin. Based on the measured percent carboxy hemoglobin (%COHb) in the employee's blood, the employee was exposed to carbon monoxide (CO) during a 60 minute occupational exposure at a mean calculated 761.9 ppm CO level. The %COHb in the employee's blood reached a calculated peak level of 27.0%.  Atmospheric pressure, height, weight, activity levels, tobacco smoking behavior, and other factors were taken into account. The 8-hour TWA exposure was 95.2  ppm CO, which is 1.9 times the OSHA TWA PEL of 50 ppm CO.
