29 CFR 1910.23(c)(4):Portable ladders. The employer must ensure: (4) Ladders are used only on stable and level surfaces unless they are secured or stabilized to prevent accidental displacement; a) On or about January 18, 2025, the employer failed to ensure that the extension ladder used to gain access to the manhole of the in-process bulk acid tank was secured or anchored. As a result, employees were exposed to a fall hazard and an employee was hospitalized after falling.

29 CFR 1910.23(c)(11):(11) Portable ladders. The employer must ensure: (11) Portable ladders used to gain access to an upper landing surface have side rails that extend at least 3 feet (0.9 m) above the upper landing surface (see Figure D-1); a) On or about January 18, 2025, the employer failed to ensure that the portable ladder, set up in the ARU room, was properly set up in that the side rails of the ladder extended 3 feet above the landing surface. As a result, an employee fell from the ladder, resulting in a hospitalization.
