29 CFR 1926.451(a)(6):  Scaffolds were not designed and constructed by a qualified person:    Location: 1 Ruth Court, Monsey, NY    a) On or about January 12, 2025, an employee was working on a soffit approximately 16' 9" high from a makeshift scaffold that was constructed by placing a 24' long, 12" wide aluminum stage between two ladders. The scaffold was not designed and constructed by a qualified person exposing an employee to fall hazards of approximately 11'7".  NOTE: Because abatement of this violation is already documented in the casefile, the employer need not submit certification nor documentation of abatement of this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities were not performed only by experienced and trained employees selected for such work by the competent person.  Location: 1 Ruth Ct, Monsey, NY  a) On or about January 09, 2025, the employer did not ensure that two pump jack scaffolds used in the back and south side of the house, as well as a makeshift scaffold used in the front of the house were erected under the supervision and direction of a competent person exposing employees to fall hazards between approximately 11'7" and 17'10".   b) On or about January 09, 2025, the employer did not ensure that two pump jack scaffolds used in the back and south side of the house, as well as a makeshift scaffold used in the front of the house were erected only by experienced and trained employees exposing employees to fall hazards between approximately 11'7" and 17'10".  NOTE: Because abatement of this violation is already documented in the casefile, the employer need not submit certification nor documentation of abatement of this violation as normally required by 29 CFR 1903.19.

Location: 1 Ruth Court, Monsey, NY  a) On or about January 12, 2025, an employee was exposed to a fall up to approximately  11'7" to a concrete slab below while working from a scaffold constructed by horizontally placing a stage on the 12th rung of two (2) metal ladders. Location: 1 Ruth Court, Monsey, NY  a) On or about January 12, 2025, an employee performing soffit work from a makeshift scaffold was not trained by a qualified person on how to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The employee was exposed to fall hazards approximately 11'7" to the concrete slab below.  NOTE: In addition to abatement certification, the employer is required to submit abatement documentation for this item, failure to comply will result in an additional penalty of $1,000.00 as per 29 CFR 1903.19.
