29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) On or about January 24, 2025, in the facility, employees were required to cut and grind quartz and granite slabs. The employer did not ensure that the employees used protective safety glasses, googles, or face shields. Employees were thereby exposed to potential eye injuries from flying particles from quartz and/or granite.

29 CFR 1910.1053(f)(2)(i): The employer did not establish and implement a written exposure control plan contained at least the following elements: a description of the tasks in the workplace that involve exposure to respirable crystalline silica; a description of the engineering controls, work practices, and respiratory protection used to limit employee exposure to respirable crystalline silica for each task; and a description of the housekeeping measures used to limit employee exposure to respirable crystalline silica.   a) On or about January 24, 2025, in the facility, the employer failed to establish and implement a written exposure control plan to protect employees from Respirable Crystalline Silica (RCS).

29 CFR 1910.1053(j)(1): The employer did not ensure that each employee was trained in accordance with the provisions of the Hazard Communication Standard (HCS) and paragraphs (j)(3)(i)(A)-(j)(3)(i)(E) of this section.  a) On or about January 24, 2025, in the facility, the employees were exposed to Respirable Crystalline Silica (RCS) when performing cutting, polishing and interacting with RCS containing materials. Exposed employees were not trained and able to demonstrate understanding of the health effects of exposure; task(s) which could result in exposure; measures the employer has implemented to protect employees from exposure; purpose of the medical surveillance program and a copy of the regulations related to RCS. The employer failed to develop a hazardous communication program which included the required information related to RCS.
