29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) On January 28, 2025, at the above addressed jobsite, employees performing roofing work on a residential home, approximately 10 feet and 7 inches above the ground, were not secured to personal fall arrest systems or other means of fall protection, thereby exposing the employees to fall hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On January 28, 2025, at the above addressed jobsite, the portable ladder used by employees to access and egress the roof of the house, measuring approximately 16 feet five (5) inches from ground to eve, was not extended to have the side rails at least three (3) feet above the upper landing. No abatement certification or documentation is required for this item.
