29 CFR 1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer: a. At 4590 Atlantic Avenue, Daytona Beach, Florida: On or about January 29, 2025 and times prior, employees were required to wear NIOSH approved, 3M Brand, N95 filtering facepiece dustmask respirators when sanding walkways and the employer did not implement a written respiratory protection program that addressed the worksite-specific procedures such as but not limited to employee medical evaluations, fit testing, and training on the use, maintenance and care of the respirators.
