29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a) Located at 143 Imperial Dr SW, Lot RYA 49, Pataskala, OH 43062: On or about January 29, 2025, the employer did not conduct frequent and regular inspections of the job site. As a result, employees were exposed to fall hazards greater than 22 feet while performing residential construction.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Located at 143 Imperial Dr SW, Lot RYA 49, Pataskala, OH 43062: On or about January 29, 2025, the employer did not ensure that employees installing roofing were protected from falling by a fall protection system. As a result, employees were exposed to a fall hazard of greater than 22 feet while performing residential construction.

29 CFR  1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:  a) Located at 143 Imperial Dr SW, Lot RYA 49, Pataskala, OH 43062: On or about January 29, 2025, employees were performing residential construction without the use of proper anchorage, thereby exposing employees to fall hazards of more than 22 feet.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Located at 143 Imperial Dr SW, Lot RYA 49, Pataskala, OH 43062: On or about January 29, 2025, the employer failed to ensure that each employee exposed to a fall hazard was trained on the hazards of falling and the procedures to minimize the hazards in the work area. As a result, employees were exposed to fall hazards greater than 22 feet while performing residential construction.
