29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a) Roof, 25540 Gray Stone Drive, Madison, AL: On or about January 29, 2025, the employer exposed employees to struck-by hazards, in that the employer did not ensure that the employees were wearing safety glasses while operating pneumatic nail guns on the residential 10/12 pitch roof at heights 6 feet and greater to the ground below while employees were engaged in shingle installation activities.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) Roof, 25540 Gray Stone Drive, Madison, AL: On or about January 29, 2025, the employer exposed employees to fall hazards, in that the employer did not ensure that the employees were wearing fall protection or installed guard rails around the unprotected sides and edges of the 10/12 pitch residential roof while performing shingle installation activities at a height of approximately 12 feet, 10 inches to the ground below.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) Roof, 25540 Gray Stone Drive, Madison, AL: On or about January 29, 2025, the employer exposed employees to fall hazards, in that the employees did not recognize fall hazards while engaged in shingle installation activities on the 10/12 pitch residential roof with unguarded edges/sides at heights 6 feet and greater to the ground below.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
