29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): a) On or about January 28, 2025, and at times prior, the employer, Western Gravel Precast LLC, did not ensure employees were protected from fall hazards while performing work on the mixing platform, which was approximately 20 feet above the lower ground level. Employees were required to access the mixing platform to clear accumulated debris and for spray cleaning operations of the concrete mixing drum. Spaces adjacent to the front and rear of mixing drum did not have guardrails or other means of fall protection. This condition exposed employees to fall hazards. b) On or about January 28, 2025, and at times prior, the employer, Western Gravel Precast LLC, did not ensure employees were protected from fall hazards while performing work on the conveyor platform, which was approximately 20 feet above the lower ground level. Employees were required to access the conveyor platform to clear accumulated debris. The platform did not have guardrails or other means of fall protection. This condition exposed employees to fall hazards.

29 CFR 1910.28(b)(7): The employer did not ensure that each employee on a walking-working surface near an opening, including one with a chute attached, where the inside bottom edge of the opening is less than 39 inches (99 cm) above that walking-working surface and the outside bottom edge of the opening is 4 feet (1.2 m) or more above a lower level is protected from falling by the use of one of the systems listed in 29 CFR 1910.28(b)(7)(i)-(iv): a) On or about January 28, 2025, and at times prior, the employer, Western Gravel Precast LLC, did not ensure employees were protected from fall hazards while performing cleaning operations on the mixing platform, which was approximately 20 feet above the lower ground level. Employees were required to access the mixing platform to perform spray cleaning operations of the open floor chute. The work area in front of the open floor chute did not have guardrails or other means of fall protection. This condition exposed employees to fall hazards.

29 CFR 1910.28(c)(3): The employer did not barricade the areas into which objects could fall and did not prohibit employees from entering the areas: a) On or about January 28, 2025, and at times prior, the employer, Western Gravel Precast LLC, did not ensure employees on a lower level were protected from overhead struck-by hazards. Employees on upper levels were required to hoist tools from the lower ground level using a rope and bucket in which the tools were placed. The employer did not barricade the areas in which tools could fall and did not prohibit employees from entering the areas. This condition exposed employees working on the lower level to struck-by hazards.
