29 CFR 1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a nail gun.  a) New residential construction located on Lot #24 Cavalier Way, Duluth, GA 30095, Roof: On or about 02/03/2025, the employer exposed employees to struck by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees operating these tools at 130 PSI.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) New residential construction Located on Lot #24 Cavalier Way, Duluth, GA 30095, Lower roof: On or about 02/03/2025, the employer exposed employees to fall hazards at approximately 11 feet, 2 inches to the lower ground level, in that the ladder used to access the second floor of the structure was not extended at least 3 feet above the upper landing surface.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) New residential construction located on Lot #24 Cavalier Way, Duluth, GA 30095, Roof: On or about 02/03/2025, the employer exposed employees to fall hazards of approximately 22 feet, 2 inches to the lower ground level, in that a fall protection system was not provided to an employee engaged in framing activities.  JML General Construction, LLC was previously cited for a violation of this occupation safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 1499018, citation number 1, item number 4 and was affirmed as a final order date on 12/20/2020, with respect to a workplace located at Morgan Landing subdivision, lots 27-33, Buford, GA.
