Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems:  On or about January 31, 2025, Dagoberto Arellano dba: Dagoberto Arellano did not ensure employees roofing a residential building at least 16 feet above the lower level, were protected from falls by use of guardrails or personal fall arrest system at a worksite located at 1028/1030 Arlington Way in Warrenton, Missouri.

29 CFR 1926.59: The employer had not developed a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) as incorporated by reference:  29 CFR 1910.1200(e)(1): Employers had not developed, implemented, and maintained at each workplace, a written hazard communication program which at least described how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets (SDSs), and employee information and training would be met.  On or about January 31, 2025, Dagoberto Arellano, dba:  Dagoberto Arellano did not develop, implement, and maintain at each workplace a written hazard communication program which at least described how the criteria specified in paragraphs (f) for labels and other forms of warning, (g) for SDSs, and (h) for employee information and training would be met. Gasoline was utilized by employees to power air compressors for pneumatic nail guns in a site located at 1028/1030 Arlington Way in Warrenton, Missouri. The employer did not have a written hazard communication program nor did they have SDSs available to employees.
