OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards associated with inadequately maintained racking systems: a) 2145 Ticonderoga Blvd. Chester Springs, PA - Warehouse Area - On or about February 4, 2025, an employee was working within the vicinity of a industrial steel racking system which had visible damage and were not secured by having at least one bolt in the base of each upright. The racking system was used to store pallets with various household items and wooden storage boxes stacked on the second and third levels, exposing employee working near the damaged and unsecured racks to falling objects and rack tip overs.

29 CFR 1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a) Jobsite: 2145 Ticonderoga Blvd. Suite 450 Chester Springs, PA - On or about February 4, 2025, the employer did not ensure that an employee operating a forklift in the warehouse was protected from injuries by being trained on forklift operations.
