29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) In the Facility, on or about February 11, 2025 - The employer did not administer a continuing, effective hearing conservation program at the facility whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level of 85 decibels. An employee designated as a Miter Saw Operator/Welder was exposed to noise at a level of 235.6% of the allowable limit during a 345 minute sampling period on February 11, 2025. This exposure is equivalent to a sound level of 96.2 dBA for the dose and time of employee exposure and is 2.8 times in excess of the 85 dBA action level (50%) at which the hearing conservation program is required.
