29 CFR 1910.178(l)(1)(ii):Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). On or about February 5, 2025, an employee operated a rough terrain fork truck prior to completing the required training, exposing employees to stuck-by hazards. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied. On or about February 5, 2025, a rough terrain fork truck elevated a wooden box (scaffold) that was not attached to the forks of the fork truck, exposing the employee to a fall of 18 feet. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. On or about February 5, 2025, a rough terrain fork truck elevated an employee in a plywood box used as a scaffold, exposing the employee to a fall of 18 feet. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
