29 CFR 1910.134(c)(2)(ii):The employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator: a) On or about February 06, 2025 - Mercury Paint at 4808 Farragut Road, Brooklyn, NY 11203 - Production Area Employees performing paint mixing were provided with respirators such as but not limited to 3M 6200 half-face elastomeric respirator for voluntary use. The employer did not ensure that employees were medically able to use that respirator. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1910.134(c)(2)(i):Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: a) On or about February 06, 2025 - Mercury Paint at 4808 Farragut Road, Brooklyn, NY 11203 Employees performing paint mixing were provided with respirators such as but not limited to 3M 6200 half-face elastomeric respirator and AllPro N-95 particulate respirator for voluntary use. The employer did not provide respirator users with the information contained in Appendix D of this standard. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
