29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): a) Work site, Hickory Bush Lane - On or about January 29, 2025 and at times prior thereto, employees were exposed to fall hazards in that they were conducting tree felling work next to an unprotected cliff face and an unidentified mineshaft and did not have fall protection.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment: a) Work site, Hickory Bush Lane - On or about January 29, 2025 and at times prior thereto, employees were conducting tree felling work and did not have personal protective equipment such as fall protection. The employer did not assess the workplace for hazards associated with tree felling work exposing employees to fall hazards associated with an open mine shaft.
