29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  a) New residential construction located at 251 Hensley Park Lane, Dawsonville, GA 30534: On or about 02/07/2025, the employer exposed employees to struck-by hazards, in that hardhats were not provided to employees while transporting roofing materials on the ground level to the upper roof working level working directly below the material hoist equipment.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) New residential construction located on 251 Hensley Park Lane, Dawsonville, GA 30534, Roof: On or about 02/07/2025, the employer exposed employees to fall hazards of approximately 23-feet, 4-inches to the lower level, in that a fall protection system was not provided to employees engaged in roofing activities.

29 CFR 1926.552(a)(1): The employer did not comply with the manufacturer's specifications and limitations applicable to the operation of all hoists and elevators.                                                                    a) New residential construction Located on 251 Hensley Park Lane, Dawsonville, GA 30534: On or about 02/07/2025, the employer exposed employees to fall hazards as the employer allowed employees to use the TranzSporter Platform Hoist as a ladder to access the roof. Manufacturer's general safety instructions state that this hoist should never be used as a ladder or climbed by personnel.

29 CFR 1926.552(a)(4): Hoisting ropes shall be installed in accordance with the wire rope manufacturers' recommendations.  a) New residential construction located on 251 Hensley Park Lane, Dawsonville, GA 30534: On or about 02/07/2025, the employer exposed employees to potential struck-by hazards, in that the employer did not follow the manufacturer's specifications of the TranzSporter Platform Hoist as the wire cable it was manufactured with was replaced using a rope.
