29 CFR  1926.1053(b)(15):Ladders were not inspected by a competent person for visible defects on a periodic basis and after an occurrence that could affect their safe use:  On or about February 7, 2025, at the job site located at 183 Aqueduct ST, Akron Ohio 44303; the employer did not ensure portable ladders were inspected prior to use. Employees utilized a portable ladder that was missing the yellow foot cleat that would level and prevent the ladder from slipping out while under load. The employees utilize the portable ladder to gain access/egress trenches (graves) ranging in depth from 3.3 feet to greater than 6 feet deep. The foreman works along side the ground crew (grave diggers) and did not inspect the portable ladder prior to being used.

29 CFR  1926.1053(b)(16):Portable ladder(s) with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired.  On or about February 7, 2025, at the job site located at 183 Aqueduct ST, Akron Ohio 44303; the employer did not ensure that portable ladders being utilized to gain access/egress from burial vaults/trenches (graves) were free from structural defects and or missing cleats. The employees utilize the 8-foot portable ladder 3 to 8 times a week to gain access/egress from trenches. The foreman was on site, assists in the graving digging process and utilizes the portable ladder to do the same work activity.
