29 CFR 1926.652(f): Employees were permitted to work on the faces of sloped or benched excavations at levels above other employees:  a) University Avenue trench; On or about January 27, 2025, employees were working in the bottom of a trench to set underground utilities for a townhouse complex.  Employees were standing on the benched section of the excavation, above other employees, exposing all the employees in the trench to cave-in hazards.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.  Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access.  a) Middle of Trench; On or about January 27, 2025 and times prior, employees working in a trench were using an 18-foot extension ladder for entry and egress. The ladder extended approximately 6 inches above the working surface and exposed employees to falls up to 11 feet.  b) End of Trench; On or about January 27, 2025 and times prior, employees working in a trench were using a 20-foot extension ladder for entry and egress. The ladder extended approximately 18 inches above the working surface and exposed employees to falls up to 11 feet.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder:   a) Middle of trench; On or about January 27, 2025, employees were using a ladder to enter and exit a trench.  The ladder was positioned against the sides of the trench in a manner that caused the ladder to be placed at an angle 3/4 the length of the ladder, exposing employees to falls up to 11 feet.  b) End of trench; On or about January 27, 2025, employees were using a ladder to enter and exit a trench.  The ladder was positioned vertically and behind a concrete sewage pipe, exposing employees to falls up to 11 feet.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  a) University Avenue trench; On or about January 27, 2025, employees were working in a trench to install sewage for a townhouse complex.  Employees were working near an excavator while in the trench and were not wearing hardhats, exposing employees to impact hazards.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
