29 CFR 1926.652(b)(1)(i) Excavations shall be sloped at an angle not steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal), unless the employer uses one of the other options listed in 1926.652 (b)(1)(ii) thru 1926.652(b)(4)(iii). a) University Avenue trench; On or about January 27, 2025, employees were working in a trench to set underground utilities for a townhouse complex. Employees working in the trench were exposed to cave-ins due to the excavation being improperly benched for Type B soil. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.

Employees were standing on the benched section of the excavation, above other employees, exposing all the employees in the trench to cave-in hazards.
