29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Worksite was located at 1625 Lake Avenue, Point Pleasant Beach, NJ 08742 A worker was observed installing sheathing on the roof of a three-story single-family residence undergoing renovation while not utilizing fall protection. Violation was observed on or about February 7, 2025 b) Worksite was located at 1625 Lake Avenue, Point Pleasant Beach, NJ 08742 Three workers were observed accepting a delivery of lumber from a JLG SkyTrak Telehandler to the third-story of a three-story single-family residence undergoing renovation while not utilizing fall protection. Violation was observed on or about February 7, 2025 c) Worksite was located at 1625 Lake Avenue, Point Pleasant Beach, NJ 08742 Two workers were observed installing frame and bracing on the second-story deck of a three-story single-family residence undergoing renovation while not utilizing fall protection. Violation was observed on or about February 7, 2025 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: a) Worksite was located at 1625 Lake Avenue, Point Pleasant Beach, NJ 08742 A worker was observed straddling the top of a four foot fiberglass and aluminum step-ladder while installing a bracket on the second floor deck of a three-story single-family residence undergoing renovation. The worker utilized the top step, the top of the ladder and the top rear rail as steps while doing this work. Violation was observed on or about February 7, 2025 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
