29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a) On February 10, 2025, located inside an active construction gas station site, the employer failed to conduct frequent and regular inspections of the job-site in that the employer exposed employees to overhead hazards in that an employee was not wearing a hard hat and struck his head ingressing a scissor lift, and exposed employees to fall hazards in that the employer allowed employees to operate a lift without the rear mid-rail chain attached exposing employees to a 15' fall hazard.

29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. a.) On or about February 10, 2025, the employer failed to ensure that employees wore hard hats while working in areas with overhead hazards during the installation of steel framing. As a result, an employee was exposed to a head injury risk when they struck their head on the guardrail while ingressing the scissor lift.

29 CFR 1926.451(g)(1)(vii):For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a.) On or about February 10, 2025, the employer failed to provide a proper guardrail system or fall protection system for employees working from a scissor lift while installing steel framing, specifically by not having the rear mid-rail chain attached. As a result, employees were exposed to a fall hazard of 15 feet due to the lack of guardrail protection on the lift.
