29 CFR 1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: (a)Shop - On or about February 11, 2025, the employer failed to establish a Lockout Tagout Program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on machines, such as but not limited to the XP Saber CNC saw Jet serial # 682578 machines during blade changes, where the unexpected energization, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. No abatement certification or documentation is required for this item.

29 CFR 1910.178(a)(4): Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: (a) Shop- On March 25, 2025, the employer used a Vestil LMS-EBNT boom attachment equipped with an Aardwolf Industries LLC stone slab lifting clamp on a Nissan Model PJ02A25PS (LP) forklift without requesting the manufacturer's prior written approval, exposing employees to crushed-by and struck-by hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
